Definitions

“Business Hours” 8.30am – 5pm Monday to Friday
“Lab Zone” means the area of the floor plan dedicated to ACS Lab members

These terms and conditions may be updated periodically at ACS’ discretion.

Benefits of Membership

  • Non-exclusive 24/7 access to the Office Space dependent on requirements and accepted fees as shown in schedule A of the Agreement.  Office and ICT support is only available during Business Hours.
  • Regular maintenance of the Office Space.
  • Furnishings being work-stations and chairs.
  • Heat and air-conditioning in the Office Space.
  • Electricity based on administrative office use.
  • Use of printers/copiers/scanners available at the Premises subject to a fair use policy, additional charges may apply.
  • Fully managed, high-speed, highly-available, carrier-redundant fibre broadband connection.
  • Unlimited internet usage.
  • Use of the Premises kitchen areas and unlimited tea and coffee for you, your team and any guests.
  • Acceptance of mail and deliveries on behalf of your business during normal Business Hours
  • Access to meeting rooms and quiet rooms in the Lab Zone subject to a fair use policy
  • Able to participate in weekly and monthly Labs initiatives
  • ACS Membership for all individuals of the ACS Labs Member which gives you discounts on insurance, access to corporate Qantas Club Membership and the Ambassador Card which gives you access to discounts on a whole range of products and services www.ambassadorcard.com.au
  • ACS is an approved accelerator with AWS Activate and is able to assist our Founders with $10k in credits and $5k in business support to access dedicated tech support for a year
  • Lockers for ACS Lab Members allocated to desks in the main Labs Zone where available, not private offices.  ACS does not accept responsibility for any loss or theft of or damage to property.
  • End of Trip Facilities including showers and bike racks.
  • Access to Binders, Laminator, Secure waste and Paper Recycling subject to a fair use policy.
  • Multiple Collaboration areas including the main kitchen/break out space, seating booths, high bench tables and stools, subject to fair use policies.
  • Available Technology includes Tech Tables and Interactive Media Hub (Sydney and Melbourne Lab only), available for presentations, subject to booking and availability.
  • Breakout zones and entertainment area.
  • Access to industry mentors.
  • Members receive a $25,000 processing discount with Stripe. Strip will waive all fees on your first $25,000 of card transactions processed in the first year with Stripe. For any Startup already processing with Stripe, they will waive fees on your next $25,000 in processing.
  • Microsoft for Startups will provide qualified startups up to USD $120k of free Azure credits for 2 years, plus access to technical support and business enablement support.
  • Hubspot for Startups – Access to Hubspot Growth Platform, a full suite of software for marketing, sales and customer service with a completely free CRM at its core at a startup-friendly price. A startup with under $2 million in funding means you are eligible for up to 90% off HubSpot software in your first year, 50% off in your second, and 25% off ongoing.
  • A startup who has raised over $2 million in named funding up to and including Series A means you are eligible for up to 50% off in your first year, and 25% off ongoing.
  • Google Cloud – Spark Package – Startups eligible for the Spark Package will receive $20,000 in Google Cloud Platform and Firebase Credits, for 12 months.
    In addition to Google Cloud Platform Credits, startups in our Spark tier are eligible for:
    • Invitations to exclusive, local Google Cloud events
    • $500 in Qwiklabs credits to kickstart your company’s hands on lab training initiatives
    • $200/month for Google Maps API, good for 12 months

When accessing the Premises and Services the ACS Labs Member must:

  • not violate any applicable laws or regulations;
  • not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (including the right of privacy) of others;
  • not alter any part of the setup of the Premises;
  • not hold yourself out as a representative of ACS or attempt to assume any obligations on behalf of ACS
  • not leave any valuable possessions unattended in the Premises;
  • immediately report any injuries on Premises to the Office Manager and provide written record;
  • respect the Premises and take good care of property owned by ACS at all times;
  • comply with the Code of Conduct and House Keeping Rules and any reasonable requests or directions by ACS at all times;
  • ACS may prohibit or halt any activity in the Premises which in its opinion is objectionable, dangerous, unlawful, infringes the Intellectual Property Rights of ACS or a third party or which is potentially detrimental to ACS’ reputation;
  • These Terms and Conditions create no tenancy interest, leasehold estate or other real property interest in your favour with respect to the Premises;
  • ACS Labs Members must rectify any damage to the Premises, or Property owned by ACS, (fair wear and tear excepted) caused by the Member;
  • ACS at any time giving reasonable notice may change the location of the Accelerator, referred to as the Premises
  • ACS Labs Members are not to use the ACS address as their registered address (ABR), however can be used for day to day deliveries;
  • Lost or replacement access passes will incur a cost of $50 each;
  • When accessing the ACS network and systems the ACS Labs Members must not:
    • Attempt to undermine the security or integrity of ACS’ computing systems or networks;
    • Transmit files that may damage any other person’s computing devices or software/content that may be offensive or material or data in violation of any law (including data or other material protected by copyright or trade secrets which the Accelerator Member do not have the right to use);
    • Attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any computer programs used;
    • Install any cabling, IT or telecom connections at the Premises without the consent of ACS (which ACS may refuse at its absolute discretion).
  • ACS Labs Member's access to the network and the Premises and use of the ACS Membership is at Accelerator Member's risk.
  • ACS does not make any representations as to the security of ACS’ network or internet connections. Accelerator Residents must adopt the security measures (e.g. encryption) Accelerator Residents believe to be appropriate to its circumstances.
  • Accelerator Member must obtain and maintain appropriate insurance to cover their business including but not limited to:
    • public liability insurance;
    • workers compensation insurance; and
    • insurance to protect your Property.

You are responsible for any tools of trade and equipment brought into the space. You must provide evidence to ACS that such insurance has been taken out including by providing certificates of currency for the insurance if requested.

  • Accelerator Member must notify ACS of any changes in contact details of the business and/or the primary contact for the Accelerator Member by emailing the Office Manager.  The member must also notify ACS when members within their team cease to be employed.  ACS is not responsible for human resource management of your business.
  • ACS Labs Members must supply ACS a copy of their annual financial statements every year, including the year prior to the initial agreement to become an accelerator member as well as quarterly financials, on an ongoing basis.  This information is kept confidential, and only used to assess revenue growth of our members in line with internal KPI’s.

Meeting Rooms & Collaboration Spaces

  • ACS Labs have meeting rooms available, subject to booking, availability and fair use.
  • Booking of meeting rooms must be made using the online booking systems available.
  • ACS reserves the right to accept or reject your booking for any reason at any time.
  • If you use a meeting room without having made a booking you may be asked to pack up and vacate the meeting room immediately (which you must do), even if not booked by another person.
  • Various size rooms are available either in the ACS Lab zone or the ACS Front of House which may be booked subject to availability, some rooms may incur a charge.
  • Collaboration spaces where available, are available for short periods up to two hours, unless special arrangements have been made with the Hub team for an extended period.
  • You must leave the room as it was when you walked in, including; Chairs tucked in, whiteboards cleaned, cups/drink bottles/water jugs removed.

The following policy outlines our expectations for all those who participate in our community, as well as the consequences for unacceptable behaviour.

If you have a team working from the Lab, please make sure each team member (including employees and contractors) are made aware of and agree to this Policy. You (the founder) will be made responsible for any violation of this policy made by your team members. A violation from a team member may result in the whole team being put on probation and/or banned from The Lab.

All ACS Lab Members are expected to adhere to the following Good Practice Policy, in order to create a safe, respectful, and productive environment for the Accelerator space to operate.

Values

  • Always acting out of respect and concern for others;
  • Always behave in a manner that conforms to member standards;
  • Respect physical and emotional boundaries;
  • Always ask before touching, and check in before discussing topics that may trigger emotional or mental discomfort to those around you;
  • Not making assumptions about identity, experiences, or preferred pronouns;
  • Not using words or holding conversations that are racist, sexist, transphobic, homophobic, classist, cissexist, ableist or otherwise.

Expected Behaviours

All members, contractors and visitors must:

  • Be considerate, respectful and collaborative;
  • Refrain from demeaning, discriminatory, or harassing behaviour in speech, in person or online.
  • Be mindful of their surroundings and of their fellow members, visitors and contractors of the space. Alert management immediately if they notice a dangerous situation, someone in distress, or violations of the Terms & Conditions, even if they seem inconsequential;
  • Remember that The ACS Lab may be shared with members of the public, please be respectful to all patrons who may be in the office at any period of time;
  • Respect and adhere to the Good Practice Policy in its entirety, along with any written ACS guidelines and policies;
  • Avoid unnecessary wastage or damage to the Premises or ACS assets and consumables;
  • No smoking (including e-cigarettes, regardless of tobacco content);
  • Respect others’ space and equipment, including being aware noise, and other distractions. This is a space for working and considerate social interaction. Don’t touch, use, or move others’ property without explicit permission. If in doubt – ask!
  • Label your own items: This makes it clear that an item is personal property and not there for the general use of/consumption by the community;
  • Please do not touch or consume unmarked food or drink in the fridge or kitchen.  Often these items have been purchased for a specific event and are not for general consumption. Items that are free for anyone to consume should be marked as such;
  • Be trustworthy, make this space feel safe and comfortable.

Harassment

ACS is dedicated to providing a safe space where all people regardless of gender, sexual orientation, disability, physical appearance, race, or religion are accepted and respected. Harassment is not tolerated.

Harassment includes but is not limited to offensive verbal comments, related to gender, sexual orientation, disability, physical appearance, race, religion or otherwise, deliberate intimidation, stalking, following, harassing photography or recording, inappropriate physical contact, displaying sexual images in publicly visible areas, unwelcome sexual attention, or advocating for, or encouraging any harassing behaviour. Parties asked to stop any harassing behaviour are expected to comply immediately.

If you are being harassed, or notice that someone is participating in harassing behaviour, please notify the Director of the Accelerator immediately, or if non-urgent, contact them anonymously after the fact. Any reports of harassment to ACS will be treated as anonymous and your name will not be included in any communication with the offending parties unless specifically requested.

Unacceptable Behaviour

We do not tolerate harassment of any members or visitors in any form. Sexual language or imagery is not appropriate in any part of the office. Members or visitors violating these rules may be banned from further participation in The Lab.

Harassment includes offensive verbal comments related to gender, sexual orientation, disability, gender identity, age, race, religion, the use or display of sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, inappropriate physical contact, and unwelcome sexual attention. Members or visitors asked to stop any harassing behaviour are expected to comply immediately.

Consequences of Unacceptable Behaviour

Unacceptable behaviour from any member, team member or visitor of ACS Labs will not be tolerated.

Anyone asked to stop unacceptable behaviour is expected to comply immediately. If a member engages in unacceptable behaviour, we may take any action deemed appropriate, up to and including a temporary ban or permanent ban from participation at ACS Labs.

The ACS Lab is all about an environment to allow collaboration and the ability to complete tasks when needed. These rules are to encourage and ensure the Labs can be used by all residents and visitors in an appropriate and safe manner. Continuous disregard for these obligations may potentially see your membership terminated by Management.

To protect the safety of all residents, you are expected to comply on time with the law and the requirements of all relevant authorities. In the event that these rules change, you will be sent notification via email but essentially it is your responsibility to keep yourself up-to-date.

Please acknowledge that the Labs is a shared office, workspace and events facility and needs to be used in such manner. Please note desk allocation may change during your membership to accommodate growth and changes of other teams.

We endeavour to have everything here at the Labs clean and working as it is intended however, please tell us immediately if something is broken or not working. This includes the electrics, security, bathrooms/toilets and kitchen facilities.

Safety

Fire exits and location of Fire extinguishers will be shown to you on your Induction.
If an Emergency situation arises after hours and on the weekend - Get out and phone 000.
First Aid kit – located under the sink in the cupboards
Door Locking - doors must be locked at all times for the security of members and equipment.

Access 

Your access card allows 24/7 access to The Labs. The Access card belongs to the member only and cannot be shared with other members, friends, family or co-workers. 

ACS Labs are staffed from 8.30am to 5pm Monday to Friday, excluding public holidays.  If your access card is lost or stolen, notify management immediately. It is your responsibility to cover the costs of a replacement card.

Access card must be returned on or prior to your last day of membership and no later.

Each member will receive an access card upon joining; if you misplace your access card, a fee of $50.00 applies to replace it. 

End of Trip Facilities - are available for members however this must be arranged through management.

Visitors 

Any visitors that come into the Lab that are not already members MUST BE accompanied by a member. For your security, there are cameras fitted throughout the facility and anyone seen with ‘strangers’ in the Lab may jeopardise their membership.

All visitors to Sydney and Melbourne need to be registered to enable Concierge on the ground floor to allow them access to the floor in which the Office Space is located.  All ACS Labs members are required to register their own guests using the building management portal.  The following information is required, full name, company name and mobile number, concierge require 24 hour’s notice before they arrive.

People coming for meetings at the Labs must contact the member they are meeting.

Kitchen

Any consumables stored must have your name clearly marked and dated

There is a fridge provided for residents. Any consumables stored must have your name clearly marked and dated. No plastic bags are allowed in the fridges. Fridges are cleaned every Friday. Anything without a name will be binned

Please do not leave dirty dishes and cutlery in the sink – Use dishwasher provided. If the dishwasher is full please put in on. If the dishwasher cycle has finished please unload and put things away to their appropriate labelled cupboards.

All cups, plates and glasses should be rinsed and placed in the dishwasher. Members are responsible for taking their used cups, glasses and plates to the kitchen. Please wipe up all crumbs and spills in the kitchen after use.

Coffee, Tea, Milk, Sugar are provided free of charge, please use responsibly.

Overall workspace 

Cleaning - Please make an effort to keep the overall labs neat and tidy. Cleaners visit the premises 5 times per week. 

Desk space 

You may bring screens, chargers, computer equipment but nothing that will interfere with our network in the Labs. Servers are prohibited

Please respect other resident’s desks and do not sit at them or touch equipment that is left on them. This is a breach of your membership and may result in immediate termination.

We strive for clean desks. This means all paperwork should be tidied away, cups, glasses and plates taken back to the kitchen and no clutter left on your desk.  All ACS Labs Members should place any personal belongings in their allocated locker or pedestal if available.  No items are to be stored under desks. 

We operate a no eating at desks policy.  This means you are not allowed to eat at your desk.  This is to ensure the Labs zone is kept clean and a professional work environment, but also to keep unsavoury smells to the kitchen area so as not to distract other members.

Printing

Many things are shared in the Labs including the printing and scanning machines. You can search for printers and connect to them over the wifi network.

Printing is limited to acceptable use - a couple of pages is fine, a book and bulk marketing material is unacceptable. Members who are taking advantage of the system will be denied access to the printers

See the Community Manager or Hub Team to replace toner, spare paper can be found at the printers.  

Wifi - personal wifi login details will be provided to members on their start date. 

Ethernet - is available throughout The Labs.  Please ask for assistance should you need it. 

Dress Code - A minimum of smart casual attire & shoes must be worn at all times

Illness - help reduce the spread of illness and stay at home if you’re ill.

Lighting - if you are the last person in the Labs, please turn off the lights as you walk out.

Bathrooms

Male and Female bathrooms are in the main corridor.  Please keep them clean at all times.  If you do see something that needs rectifying please contact the Office Manager.

Deliveries

All deliveries should be notified to the Office Manager.  Large deliveries will require the loading dock and lifts to be pre-booked. 

Building Requirements

All processes and procedures must be adhered to as defined in the Premises Guide.

Pets

Pets are prohibited on the premises - if you require a disability assistance animal, we can provide exemptions.
